Terms of Use

1.The App

Singabit helps you practise singing every day. It gives you a daily practice plan, exercises set to your vocal range, live pitch tracking, a score and a tip after each take, short lessons, and a record of your progress. The App needs access to your iPhone's microphone to hear you sing. Some features, such as purchases and iCloud sync, need an internet connection, and mobile data charges from your carrier may apply.

If you are under the age of majority where you live, use the App and buy Singabit Plus only with the permission of a parent or guardian.

2.Your Voice, Health and Safety

Singing is physical. Please look after your voice:

• Stop if it hurts. If you feel pain, strain, tightness or hoarseness, stop and rest your voice. Do not push through discomfort to reach a note or a score.
• See a professional for voice problems. If hoarseness, pain or a change in your voice lasts more than two weeks, or you lose your voice, see a doctor, ideally an ear, nose and throat specialist, or a speech and language therapist.
• The App is not medical advice. The exercises, lessons and tips are general information about singing practice. They are not a diagnosis, treatment or therapy, and they do not replace a qualified voice teacher or a medical professional.
• Protect your hearing. Keep headphones at a comfortable volume.
• Stay aware of your surroundings. Do not use the App while driving or in any situation where it could distract you from what is happening around you.

3.Feedback Is a Guide

The App's scores, stars, note results and tips are produced automatically by pitch detection on your iPhone. They measure how closely your pitch follows the notes; they do not judge tone, technique or vocal health. Their accuracy depends on your device, its microphone, background noise and how you hold the phone. They are a practice guide, not an assessment of your ability, and we do not promise any particular result from using the App.

4.Your Recordings and Shared Content

• Your recordings and practice data belong to you. They are stored on your iPhone and, for practice data, in your private iCloud storage (see our Privacy Policy).
• When you share a take as an image or video, or export your data, you are responsible for where you send it and for having the right to share it.
• Do not use the App to record other people without their consent.

5.Free Version and Singabit Plus

The App is free to download. The free version includes a selection of exercises and lessons and your recent history, with the same feedback as Singabit Plus.

Singabit Plus is an optional paid subscription. It unlocks the features shown on the purchase screen at the time of purchase, such as all exercises, all lessons and your full history. It is offered as an auto-renewable subscription, for example yearly or monthly, as shown in the App.

Prices are shown in the App before you buy and may vary by country. We sometimes test different prices, plans and purchase screens, so the offer you see may differ from what other users see. The price and terms shown on the purchase screen when you confirm are the ones that apply to you.

6.Subscriptions, Free Trials and Billing

All purchases are processed by Apple through your Apple Account. By subscribing, you agree to the following:

• Payment is charged to your Apple Account when you confirm the purchase or, if you start with a free trial, when the trial ends.
• A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price you agreed to. If the price changes, you will be notified in advance, and you can cancel before the new price applies.
• You can manage or cancel your subscription in iOS Settings › [your name] › Subscriptions. Deleting the App does not cancel a subscription.
• Free trials. A free trial may be offered to new subscribers, for the length shown in the App. Apple decides whether you are eligible, and generally allows one free trial per Apple Account. To avoid being charged, cancel at least 24 hours before the trial ends. If you allow notifications, the App reminds you 2 days before the trial ends; this reminder is a courtesy, and you remain responsible for cancelling in time. Any unused part of a free trial is forfeited when you purchase a subscription.
• Restoring purchases. You can restore Singabit Plus on any device signed in to the same Apple Account with "Restore purchases" in the App's Settings.
• Refunds. Apple handles all refunds under its own policies; request one at https://reportaproblem.apple.com. We cannot issue refunds directly.

Nothing in this section limits your statutory consumer rights.

7.Apple App Store

• Your license to use the App is granted under Apple's Licensed Application End User License Agreement ("Standard EULA"): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
• These Terms apply in addition to the Standard EULA. If they conflict on the license to use the App, the Standard EULA prevails.
• Apple is not responsible for the App or its content, and is not a party to these Terms. Support for the App is provided by us.

8.Acceptable Use

You agree not to:

• use the App for any unlawful purpose or in violation of applicable laws
• copy, modify, distribute, sell or lease any part of the App or its content, including its exercises, lessons, illustrations and audio
• reverse engineer, decompile or disassemble the App, or try to extract its source code, except where the law expressly allows it
• circumvent purchase requirements or other technical restrictions
• interfere with the App's operation or the services it relies on

9.Intellectual Property

The App and its contents are owned by Mugen Software SIA or its licensors and are protected by copyright and other intellectual property laws. This includes the exercises, practice plans, lessons, texts, illustrations, audio, design and software. Except for the limited license to use the App for personal, non-commercial purposes, no rights are granted to you.

Some audio in the App comes from third parties and is used under its own licenses, such as Creative Commons. These works and their licenses are credited in the App under Settings › Credits.

10.Third-Party Services

The App uses third-party services, including Google Firebase, RevenueCat and Apple (the App Store and iCloud). These are governed by their own terms and privacy policies. We are not responsible for third-party services.

11.Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data is processed and how. It is available in the App and at https://singabit.app/privacy.

12.Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted or error-free, or that its pitch detection, scores or feedback will be accurate in every situation. We also do not guarantee that it will remain compatible with every device or operating system version, or that particular exercises, lessons or features will always be available.

13.Limitation of Liability

To the maximum extent permitted by applicable law, Mugen Software SIA and its officers, employees and agents shall not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of or inability to use the App.

Our total liability for any claims related to these Terms or the App shall not exceed the greater of:

• the amount you paid for the App in the twelve (12) months before the claim, or
• fifty euros (€50).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law. This includes liability for intent or gross negligence, and for death or personal injury caused by our negligence.

14.Indemnification

To the extent permitted by applicable law, you agree to indemnify Mugen Software SIA against claims, losses and expenses arising from your violation of these Terms or of the rights of a third party.

15.Changes to the App and Termination

• We may update, change or discontinue the App, or any exercise, lesson or feature, at any time. To keep using the App, you may need to install updates.
• You may stop using the App at any time by deleting it. Deleting the App does not cancel a subscription (section 6).
• We may end your right to use the App if you seriously breach these Terms.
• Sections 2, 3, 9, 12, 13, 14 and 16 survive termination.

16.Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Latvia and applicable European Union law, without regard to conflict of law provisions.

If you have a complaint, please contact us first at support@mugenapps.io, and we will try to resolve it amicably. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of Riga, Latvia.

Consumer Rights. Nothing in these Terms affects your statutory rights as a consumer. This includes the mandatory consumer protection laws of the country where you live, and your right to bring proceedings in your local courts where the law allows it.

17.General Provisions

• Entire Agreement. These Terms, together with the Privacy Policy and the Standard EULA, are the entire agreement between you and Mugen Software SIA regarding the App.
• Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions stay in full force and effect.
• Waiver. If we do not enforce a provision, that does not waive our right to enforce it later.
• Assignment. You may not transfer these Terms without our prior written consent. We may transfer our rights and obligations, for example as part of a sale of the App.
• Changes to These Terms. We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and, where appropriate, in the App. Continued use of the App after changes take effect means you accept the revised Terms.
